1. Acceptance of Terms

By accessing or using the Axis Art Shop website (the “Site”), and by purchasing our printed art products (collectively, the “Services”), you agree to be legally bound by these Terms of Service (the “Terms”). These Terms constitute a binding agreement between you (“you”, “your”, or “User”) and Axis Art Shop (“Company,” “we,” “us,” or “our”).

Your use of the Site and Services is also subject to our Privacy Policy, Return Policy, Shipping Policy, and any other guidelines or policies posted on the Site, all of which are incorporated into these Terms by reference. If you do not agree with any part of these Terms or any related policies, you must refrain from accessing or using our Site or purchasing our products.

2. Eligibility

You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to use our Site and Services. By using the Site, you represent and warrant that you meet these eligibility requirements. 4. Purchases and Payment

Orders

When you place an order for physical printed artwork, you agree to pay the price listed, plus any applicable taxes or shipping fees. All prices are shown in U.S. Dollars unless otherwise indicated.

After placing your order, you will receive an order confirmation email. This confirmation does not constitute acceptance; we reserve the right to refuse or cancel orders at our discretion, particularly in cases of pricing errors, suspected fraud, or supply limitations.

Payment

We accept major credit cards, debit cards, PayPal, and other secure payment methods displayed at checkout. Payments are processed by trusted third-party providers. We do not store full payment card information on our servers.

You authorize our payment processors to charge your selected payment method for the total order amount. If your payment fails, we may cancel or suspend your order.

Pricing Errors

Despite our best efforts, products may be incorrectly priced. We reserve the right to correct pricing errors and to cancel or refuse any affected orders, with a full refund issued where applicable.

5. Product Information and Availability

All product descriptions, images, and pricing are subject to change at any time without notice. We strive to ensure accuracy but do not guarantee that product descriptions or content on the Site are error-free.

All printed artworks are produced on-demand. Availability is subject to change and we reserve the right to discontinue or modify any product at any time without prior notice.

6. Shipping and Delivery

Shipping is handled according to our Shipping Policy. Estimated delivery dates are provided for convenience only and are not guaranteed.

We are not responsible for delays caused by events outside of our control, such as postal service disruptions, customs clearance procedures, or other force majeure events.

Title and risk of loss for purchased products pass to you upon our delivery to the carrier.

As our products are custom printed on demand, returns are generally only accepted for items that are defective, damaged during shipping, or incorrect. We do not accept returns or provide refunds for reasons such as change of mind or customer error.

If you believe your order is defective or incorrect, please contact us within 14 days of delivery at support@axisartshop.com with photos and a description of the issue.

8. Intellectual Property

All content on the Site, including text, images, designs, graphics, logos, icons, and artworks, is the property of Axis Art Shop or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Purchasing a physical print does not transfer any intellectual property rights. You are granted only a limited, non-commercial right to display the physical artwork for personal use. Unauthorized reproduction, resale, modification, or commercial use is strictly prohibited.

9. User Conduct

By using our Site and Services, you agree:

Not to engage in unlawful, fraudulent, or abusive activity.
Not to infringe on our or any third party’s intellectual property rights.
Not to attempt to gain unauthorized access to our systems.
Not to use the Site in any way that could damage, disable, overburden, or impair it.
Not to post or transmit any harmful, defamatory, or obscene material.

We reserve the right to investigate and take appropriate legal action against anyone who violates these provisions.

10. Disclaimers

Axis Art Shop provides its Site and Services “as is” and “as available” without any warranties of any kind, express or implied.

We do not guarantee that the Site will be error-free, uninterrupted, secure, or that defects will be corrected. We are not responsible for issues resulting from factors beyond our control, including internet outages, device compatibility, or acts of nature.

Some jurisdictions do not allow limitations on implied warranties, so certain limitations may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Axis Art Shop shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site, the Services, or any products purchased.

Our total cumulative liability to you for any claims shall not exceed the total amount you paid to Axis Art Shop in the past six (6) months, or $100, whichever is greater.

This limitation applies regardless of the legal theory under which a claim is brought.

12. Indemnification

You agree to indemnify, defend, and hold harmless Axis Art Shop, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, costs, and expenses (including attorneys’ fees) arising out of your use of the Site or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to the Site or Services at any time, without notice, for conduct that we believe violates these Terms or is harmful to our interests.

Upon termination, your right to use the Services will immediately cease, but all provisions of these Terms that should reasonably survive termination shall survive.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of laws principles.

You agree that any dispute arising from or relating to these Terms or your use of the Services shall be brought exclusively in the state or federal courts located in California. You waive any objection to jurisdiction and venue in such courts.

We reserve the right to modify or update these Terms at any time. We will notify users by updating the “Last Updated” date at the top of this page.

Your continued use of the Site after any changes constitutes your acceptance of the new Terms.
